Sheriff Sales may be cancelled or added at the last minute and due to this ever-changing nature, there is no guarantee the posted list of sales will be current and up to date.

Sheriff's Sale Procedure (mortgage foreclosure sale)

Sheriff Sales begin at 10:00 a.m. sharp.  Mortgage foreclosure sales and other property sales ordered by the Leavenworth District Court to be sold by the Sheriff are held on Tuesdays and Thursdays (except holidays) at 10:00 a.m. in the lobby of the Leavenworth Justice Center, 601 S 3rd St., Leavenworth, KS 66048.

Register to bid - Interested parties may register to bid prior to the Sheriff Sale by completing the Sheriff Sale Registration Form or in-person no later than 9:40 a.m. on the date of the sale.  The purchasing bidder must submit payment for the sale amount and any property taxes owed no later that 2:00 p.m. on the day of the sale.

At 10:00 a.m. the clerk will announce the plaintiff name, defendant name, and court case number.  The plaintiff will open bidding.  Once the plaintiff has bid the bid is open to other bidders (third-party bidders.)

If a third-party bidder is successful in purchasing the property, the purchaser must present a picture I.D., current address, and current telephone number to the clerk and abide by the following:

The successful bidder must submit the successful bid amount to the Sheriff for The Leavenworth District Court - a cashier's check payable to the Leavenworth County District Court is required by 2:00 PM on the day of the sale.  The third-party bidder will be escorted by the Sheriff's Office to the Clerk of the District Court.  Contact 913-682-5724 to make an appointment prior to arrival.

Property taxes are the responsibility of the successful bidder - a cashier's check payable to the Leavenworth County Treasurer is required by 2:00 PM on the day of the sale.

The third-party bidder is responsible for completing all the required paperwork. The Sheriff's Office will not provide legal guidance in completing the required paperwork to complete the sale. 

Plaintiff's Attorney Responsibility

The Sheriff's fee of $15.00 is due whether the sale is held or cancelled.  The Sheriff's fee is due prior to calling the sale or cancelling the sale. If the Sheriff does not receive the fee prior to the date and time of sale, the Sheriff will cancel the sale due to lack of payment per K.S.A. 28-110. The Sheriff's Return of Sale/No Sale will not be filed with the Clerk of the District Court until payment is made.  A new Order of Sale cannot be applied for until the Sheriff's Return of Sale/No Sale cancelling the original sale has been filed with the Clerk of the District Court.  Typically, the Sheriff's Sale fee is provided with the Notice of Sale, the District Court Case number of the foreclosure must be labeled on the check.

The plaintiff shall provide the Notice of Sale to the Sheriff's Office as early as possible to start the Sheriff's Sale process. 

The Certificate of Purchase (COP) should be presented to the Sheriff's clerk at the time of sale and not filed with the Clerk of the District Court. If the Plaintiff successfully purchases the property, the COP will be completed and returned to the representing attorney. The ORIGINAL COP must be surrendered to the Sheriff to have the Sheriff's Deed signed. 

The Plaintiff's representative is responsible for providing the return of sale or no sale to the Sheriff for execution.  

The Plaintiff's representative shall complete the Sheriff's Deed and submit it and the original COP to the Sheriff for execution (signature). The deed will not be executed until all fees and delinquent property taxes are paid, as well as the required paperwork being submitted to the Sheriff.

If the plaintiff's representative E-files the case, it is the plaintiff's representative's responsibility to also submit ALL paperwork to the Sheriff. The Clerk of the District Court is not responsible to provide any of the paperwork to the Sheriff when the case is filed using the Kansas E-filing method.

Third Party Bidder Responsibility

The purchaser has no legal right to the property until after the redemption rights have been extinguished.  The defendant may remain on and maintain custody of the property until redemption rights have been extinguished.   Should the property be redeemed, the purchaser must contact the plaintiff's attorney to refund the paid funds to the purchaser.

If a third-party bidder is successful and the property is not redeemed, the purchaser should contact the plaintiffs' attorney and request them to complete the Return of Sale, Certificate of Purchase and Sheriff's Deed. The documents must be provided to the Sheriff's Office's Sheriff's Sales clerk, please contact 913-682-5724 to make an appointment - without an appointment, be prepared to drop off the deed for pick-up later (possibly not the same day.)

The Sheriff will sign the Sheriff's Deed and return it to the purchaser.  The purchaser must file the Sheriff's Deed with the Leavenworth County Register of Deeds Office.

Once the Sheriff's Deed has been executed and delivered to the purchaser, the purchaser may then begin arrangements to take custody of the property. If there are individuals remaining on the property that refuse to leave, the purchaser will need to make legal arrangements for a Writ of Assistance (eviction) with the Leavenworth County District Court.

General Information

Sales may be cancelled or added at the last minute and due to this ever-changing nature, there is no guarantee the posted list of sales is current and up to date.

Sheriff Sales are tracked by court case number, legal street address, defendant's name, and sale date. If you contact the Sheriff's Office requesting information on a Sheriff Sale, you must have at least one of these items for us to be able to search the database.

By Kansas Statute, Sheriff's Sales must be advertised for three weeks prior to being held; this is typically done via The Leavenworth Times OR The Tonganoxie Mirror.  The Leavenworth County Sheriff does not have any additional information on a property other than what is posted in the newspaper and in the Sheriff's Sale listing.  Interested bidders are responsible to investigate for further information regarding the property on their own.

An interested party has NO Right to personally inspect any property prior to the Sheriff Sale. The homeowner still has legal possession of the property until the redemption period expires. The redemption period can be anywhere from 90 to 365 days.

Tax Foreclosure

Judicial Tax Foreclosure Sales are set by the Leavenworth County Counselor's Office to be sold by the Sheriff.  Any questions relating to tax foreclosures should be directed to the County Counselor's Office. This includes all property being sold for delinquent real estate taxes.
